1. Who these terms are between
These terms are between you and Cluttr Limited, a New Zealand registered company based in Christchurch. They apply when you use Cluttr to sell your things, and when you sell for Cluttr as a reseller. By booking a collection or taking a bundle you agree to them.

2. How Cluttr works
- You photograph the things you want gone. Cluttr identifies each item and gives you an estimate.
- You book a collection and offer pickup times. A reseller takes the bundle and picks a time from the ones you offered.
- The reseller collects your items, lists them and sells them on your behalf. Your items stay yours until they are sold to a buyer.
- When an item sells, you are paid your share, or we send it to a local charity if you ask us to.
Cluttr runs the platform, sets the estimates, vets the resellers and handles the money. Resellers are independent businesses, not Cluttr employees.
3. Estimates
- Every price shown before a sale is an estimate, not a valuation or a guarantee.
- For the first 30 days after collection your reseller must genuinely work towards the estimate: listing the item properly, photographing it well, relisting it and promoting it. They may adjust the price within that window if the market says otherwise.
- If an item sells for more than the estimate, your share goes up with it.
- The reseller confirms what each item is and what condition it is in at collection. If it differs from the scan, the estimate can change.
4. What you are paid
- Cluttr costs you nothing up front.
- You receive 60% of the price each item sells for, less handling fees. The other 40% covers the reseller's work and Cluttr's service fee.
- If an item sells for more than its estimate, you receive 60% of the higher price.
- Handling fees are a collection fee on each booking, with an extra fee for bulky items such as whiteware. The app tells you that fees apply before you book, and they are taken from your share.
- You are paid when each item sells, to the bank account you give us, normally within five working days of the sale being confirmed.
- Some things cost more to photograph and list than they sell for on their own. Those travel with your bundle and are sold together as a lot.
- You can choose to send your share to a local charity instead of keeping it.
5. If something does not sell
If an item has not sold after 30 days, your reseller may lower the price to one the market will pay. If it still cannot be sold, we will contact you and agree whether it is returned to you, sold as part of a lot, or donated. We will not throw away anything that could be sold without telling you first.
6. What we take
We sell good, working things someone will happily pay for. We do not take op shop items such as clothes, everyday kitchenware, books and ornaments. We never take anything broken, rubbish or green waste, paint, chemicals or gas bottles, cots, car seats or helmets, food, toiletries or weapons. Cluttr is not a rubbish removal service, and a reseller can decline any item at collection that is not as described or is unsafe to sell.
7. What you agree to as an owner
- You own the items, or have the right to sell them, and nobody else has a claim on them.
- Your photos and descriptions are honest, including any faults you know about.
- The items are safe and legal to sell.
- You or someone you trust will be there at the pickup time you agreed, and the items will be ready.
8. What resellers agree to
- Collect at the time agreed with the owner, and treat their home and their things with care.
- List and sell in good faith, working towards the estimate for at least the first 30 days.
- Record each sale accurately in Cluttr, including the real sale price.
- Use an owner's address, phone number and photos only to complete their collection and sale.
- Hand over sale proceeds as Cluttr directs, so the owner receives their 60%. A reseller's earnings come from the other 40%, never from an owner directly.
9. Responsibility and liability
- From collection until sale, your reseller is responsible for looking after your items. If an item is lost or damaged in their care, we will work with you and the reseller to put it right, which may mean paying you the estimate for that item.
- Cluttr is not responsible for a buyer's use of an item after it has been sold.
- Except where the law does not allow it, Cluttr's total liability to you for any bundle is limited to the estimate for the items affected.
- Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
10. Problems and disputes
- If something goes wrong, email hello@usecluttr.com. We will reply within two working days and try to resolve it fairly.
- If we cannot agree, either of us may take the matter to the Disputes Tribunal or the New Zealand courts.
11. Ending things
- You can cancel a booking at no cost any time before a reseller collects it.
- After collection, you can ask for unsold items back. We will arrange their return, and any collection cost already incurred may be taken from a later sale or charged to you.
- Cluttr may suspend or close an account for breach of these terms, fraud, or treating others unsafely.

13. Changes and governing law
We may update these terms and will change the date at the top when we do. A change will not affect a bundle already collected unless you agree to it. These terms are governed by the laws of New Zealand.
